Bennu: A Travel Experience LLC – Terms & Conditions

These Terms and Conditions (“Terms”) apply to all travel planning, consulting, booking, and related services (“Services”) provided by Bennu: A Travel Experience LLC, a Washington State travel agency (“Bennu,” “we,” “us,” or “our”). By requesting or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of our Services.
Supplemental terms or policies posted on our website or provided in writing are incorporated by reference. Bennu reserves the right to modify these Terms at any time. Updated Terms will reflect a new “Last Updated” date. Continued use of our Services constitutes acceptance of revised Terms.
- Acceptance of These Terms
1.1. Any request for information, quotes, or bookings constitutes acknowledgment that you (“Customer”) accept these Terms and authorize Bennu to act as your agent in arranging travel services.
1.2. Your attention is specifically drawn to Sections 12, 13, and 14, which limit Bennu’s liability and outline strict timelines for claims.
1.3. Nothing in these Terms is intended to waive rights that cannot legally be waived under Washington State law or applicable federal law. If any provision conflicts with mandatory law, that portion is overridden only to the extent required. - Agency Relationship
2.1. Bennu acts solely as a travel agent and intermediary. We arrange travel services on your behalf with independent third party suppliers (airlines, hotels, cruise lines, tour operators, transportation companies, etc.). You authorize Bennu to enter into supplier contracts on your behalf.
2.2. All bookings are subject to the supplier’s own terms, conditions, and liability limits, which form a direct contract between you and the supplier. Bennu is not responsible for supplier acts, omissions, or service quality.
2.3. Information provided by Bennu is based on data supplied by third parties. Bennu is not responsible for inaccuracies and recommends verifying all details directly with suppliers.
2.4. COVID 19 and other health related travel requirements are subject to change. Bennu provides guidance but is not responsible for denied boarding, quarantine, or additional expenses resulting from failure to meet entry requirements. - Prices
3.1. All prices are subject to change until paid in full. Suppliers may adjust pricing due to currency fluctuations, taxes, fuel surcharges, or availability.
3.2. All amounts are payable in the currency quoted. Foreign transaction fees are imposed by your bank and are outside Bennu’s control.
3.3. Except for Bennu’s professional fees, all funds are received on behalf of suppliers. If a supplier fails to provide services, your remedy lies solely with that supplier.
3.4. Airfare is not guaranteed until paid in full.
3.5. Failure to pay by the stated due date may result in cancellation. - Passports, Visas & Travel Documentation
4.1. Customers are solely responsible for ensuring all travelers have valid passports, visas, health documents, and entry requirements. Many countries require 6 months of passport validity beyond the return date.
4.2. Bennu assumes all travelers have valid documentation unless notified otherwise.
4.3. Immigration authorities may deny entry at their discretion. Bennu is not liable for related losses.
4.4. Travelers are responsible for verifying requirements through official government sources such as: U.S. Department of State: travel.state.gov
4.5. For cruises, contact Bennu if you have not received documentation 30 days before sailing. - Travel Insurance
Bennu strongly recommends purchasing comprehensive travel insurance, including medical coverage, trip cancellation, interruption, evacuation, and baggage protection. Declining insurance is at your own risk. - Health & Vaccinations
Travelers must consult medical professionals regarding required or recommended vaccinations and health precautions. Some destinations require proof of vaccination for entry. - Amendments & Cancellations
Supplier penalties vary and may be up to 100% of the booking cost. Bennu is not responsible for supplier imposed fees. If Bennu incurs charges due to changes you request, you agree to reimburse Bennu. - Taxes & Additional Charges
Suppliers may impose additional taxes, port fees, or surcharges even after full payment. These must be paid by the traveler. - Air Schedule Changes for Cruise Packages
Flight schedules for cruise line air packages are controlled solely by the cruise line. Bennu cannot guarantee flight times, routings, or seat assignments. - Bennu Fees, Payment & Expenses
10.1. Bennu’s professional planning fees are disclosed in writing and are non refundable.
10.2. Additional fees (airport, hotel, resort, car rental, government taxes) may be collected at the destination.
10.3. Prices may change until paid in full.
10.4. Amenities or credits offered by Bennu apply only if travel is fully completed. - Force Majeure
Bennu is not liable for delays or failures caused by events outside our control, including but not limited to natural disasters, pandemics, strikes, government actions, supplier failures, or other unforeseeable events. - Liability & Limitations
12.1. Bennu is not liable for injury, loss, delay, or damage caused by suppliers or Force Majeure events.
12.2. Your legal recourse for supplier failures lies solely with the supplier unless caused by Bennu’s gross negligence.
12.3. Supplier liability may be limited by international conventions (e.g., Warsaw, Montreal, Athens).
12.4. Bennu is not liable for indirect or consequential damages.
12.5. Where permitted by law, Bennu’s liability is limited to: – Re supplying the Services, or – Paying the cost of having the Services re supplied.
12.6. Bennu makes no warranties regarding supplier products or services. - Time Limits for Claims
13.1. Any claim against Bennu must be submitted in writing within 28 days of the event giving rise to the claim.
13.2. Bennu is discharged from all liability unless suit is filed within three (3) months of the date Services were provided or should have been provided. - Privacy Policy
By providing personal information, you consent to Bennu sharing traveler data with suppliers, government agencies, and service providers as necessary to fulfill travel arrangements. International data transfer may occur. - Changes to These Terms
Bennu may modify these Terms at any time. Continued use of Services constitutes acceptance. - Jurisdiction & Governing Law (Washington State)
These Terms are governed by the laws of the State of Washington. Any dispute shall be resolved exclusively in the courts of Walla Walla County, Washington. - Washington State Seller of Travel Requirements
Bennu: A Travel Experience LLC is registered with the Washington State Department of Licensing as a Seller of Travel.

Washington State law requires Sellers of Travel to maintain a trust account or bond. Bennu complies with all requirements under RCW 19.138.
Travelers may contact the Washington State Attorney General’s Office regarding consumer rights. - Vendor Closure or Bankruptcy
If a supplier ceases operations or declares bankruptcy, Bennu will assist in attempting to recover funds or rebook services but cannot guarantee recovery. Travel insurance is strongly recommended. - Entire Agreement
These Terms constitute the entire agreement between you and Bennu. If any provision is deemed unenforceable, the remainder remains valid. - Contact Us
